In December 2023, when South Africa accused Israel of genocide before the International Court of Justice, I thought it was wrong to do so. Israel had been attacked. Its defense was legitimate. The blood was on Hamas’s hands. But over the last year, I have watched a slew of organizations and scholars arrive at the view that whatever Israel’s war on Gaza began as, its mass assault on Palestinian civilians fits the definition of genocidal violence. This is a view now held by Amnesty International, B’Tselem, Human Rights Watch, and the president of the International Association of Genocide Scholars, among many others One reason I have stayed away from the word genocide is that there is an imprecision at its heart. When people use the word genocide, I think they imagine something like the Holocaust: the attempted extermination of an entire people. But the legal definition of genocide encompasses much more than that. So what is a genocide? And is this one? Philippe Sands is a lawyer who’s worked on a number of genocide cases. He is the author of, among other books, “ East West Street ,” about how the idea of genocide was developed and written into international law. He is the best possible guide to the hardest possible topic. We're interested in trucking here at Odd Lots. It's one of those industries that can tell us a lot about the economy, both in terms of the short-term cycle, and also long-term structural trends. If you believe the hype, artificial intelligence will soon take all our jobs, or solve all our problems, or destroy all boundaries between reality and lies, or help us live forever, or take over the world and exterminate humanity. That’s a pretty wide spectrum, and leaves a lot of people very confused about what exactly AI can and can’t do. In this episode, we’ll help you sort that out: For example, we’ll talk about why even superintelligent AI cannot simply replace humans for most of what we do, nor can it perfect or ruin our world unless we let it. Arvind Narayanan studies the societal impact of digital technologies with a focus on how AI does and doesn’t work, and what it can and can’t do. With all our recent discussion on Skrmetti , and questions of scrutiny as applied to gender dysphoric individuals, the question of where women’s rights stand in this morass deserves new attention. Professor Jill Hasday has written an important book, We the Men, which is deeply relevant to these discussions. To what extent does inequality persist in the law? When Courts seek to answer this question, they often cite the great progress that has been made.
