There’s only so much you can do in a week – or, according to Oliver Burkeman, in the roughly 4,000 weeks the average human lives. Oliver is a journalist and author of the books Four Thousand Weeks: Time Management for Mortals, Meditations for Mortals, and the newsletter “The Imperfectionist.” Chris and Oliver discuss the paradox of why change can only occur once we accept that we might not be able to change. Oliver also shares how life’s mishaps can become our most treasured memories and why sharing your imperfections is an act of generosity. Sara and Jim open today’s show with a conversation about a Murdaugh juror who was excused because of a non-existent Facebook post. They are later joined by attorney and friend Joe McCulloch, who was noticeably front and center throughout the Murdaugh trial. They discuss the intersection of a Defendant’s right to a fair trial and the press’ 1st Amendment rights in the context of a disturbing South Carolina case where a prosecutor and investigators secretly recorded a defendant’s privileged conversation with his attorney after allegedly failing a polygraph. The recording was later leaked to the media. Joe obtained a ruling from the SC Supreme Court prohibiting the media from publishing the recording. Joe also provides valuable tips on DUI stops and their defense. In the last part of the podcast, Sara and Jim discuss with Joe his representation of jurors in the Murdaugh case, as well as his in-the-works screenplay about that trial.

Today’s guest Prof. Natalie Ram specializes in examining the intersection between the advancements in forensic genealogy, and its role in the criminal justice system. For 15 years, Prof. Ram has made a case that forensic genetic genealogy raises constitutional and ethical concerns, including 4th amendment violations, based on the lack of voluntariness in genetic relatedness. More specifically, Sara and Jim ask about the protocols (and oversights) that are involved with determining the perpetrator of a crime based on their genetic relationships. They take a deep dive into how the courts and law enforcement are defining the word ‘voluntary’, and also question what aspects of the 4th Amendment are regularly being violated. Later in the podcast they break down two significant cases that Prof. Ram relies on: Carpenter vs US, and State of Maryland vs Andrews. The show wraps with a focus on a burdensome benefit: the role of IGG in exonerating the wrongfully convicted. Art – Simon & Associates Music – Caleb Fletcher…
