This week on Beyond the Shelf, we continue our conversation with Pamela Deese, Partner at Arent Fox. In last week's episode, Pam gave us an overview of what ad claims are, who makes them, and what is needed to make them. This week, we discussed what happens when brands make claims that are not or cannot be substantiated. Pam shares how the National Advertising Division (NAD) of the Better Business Bureau works, and what brands need to know about the laws and regulations surrounding advertising claims. Also in the episode, we spoke about how social media factors into existing advertising laws, and why it's important that Social Media Managers at food & beverage companies should be trained on how to make accurate ad claims.
