What happens if your employer believes you are continuously underperforming in your job or your role, and your employer believes that everything that could have been done – has been done, but you have not improved?

In this week’s podcast episode, we explore these concerns through the lens of the relationship between poor performance, capability and the breach of the implied duty of mutual trust and confidence.

It's our view, that the more you are able to acquaint yourself with your employment rights in this area, the more your rights will act as an early warning system, which you can use to spot bad treatment or illegal treatment that you may be suffering at work.
