MEMORANDUM AND ORDER
· Petitioner filed a pro se petition for habeas corpus under 28 U.S.C. § 2241, claiming that he is entitled to immediate transfer to pretense custody.
· The Court granted the petition.
BOP HOLDING INMATES IN PRISON AFTER THEIR ETC RELEASE DATES:
· The Second Chance Act Has Provided the Funding but still
- Staffing for home confinement is not available, and
- Halfway House Beds are not available.
- Then, for a majority, Home Confinement has been an option since before this 2013 memo, and additional supervision can come from Federal Location Monitoring.
- Leaving some of those eligible for early release with plenty of ETC – still in prison
